近日，世界知识产权组织仲裁与调解上海中心（以下简称“WIPO仲调上海中心”）成功调解美商NBA产物股份有限公司（以下简称“NBA”）与行吟信息科技（上海）有限公司（以下简称“小红书”）的著作权纠纷案件。
The World Intellectual Property Organization (WIPO) Arbitration and Mediation Shanghai Service recently facilitated the successful resolution of a copyright dispute between NBA Properties, Inc. (“NBA”) and Xingyin Information Technology (Shanghai) Co., Ltd. (“Xiaohongshu”) through mediation.
该案是WIPO仲调上海中心接受上海市黄浦区人民法院委托，经双方当事人同意，适用WIPO ADR规则调解的案件。在调解中，中心专家围绕权利人权益保护与平台版权治理能力等问题安排多轮协商和调解，最终使双方不仅解决了争议，而且就平台版权保护的治理达成了长期与持续的合作。
The case was referred to the WIPO Arbitration and Mediation Shanghai Service by the Huangpu District Primary People’s Court of Shanghai and, with the consent of both parties, was mediated under the WIPO ADR Rules. During the mediation, the mediator facilitated multiple rounds of discussions between the parties on issues including the protection of right holders’ interests and the platform’s copyright governance capabilities. Ultimately, the parties not only resolved the dispute but also agreed on long-term and ongoing cooperation in copyright protection and governance on the platform.

In this case, NBA and Xiaohongshu agreed to cooperate on copyright protection and governance and reached the following understandings:
小红书认可NBA作为国际知名体育赛事组织，其持有的NBA知识产权具有显著的市场价值，对互联网平台持续提升版权治理能力和质效的合理需求；NBA和小红书共同认可，权利人和平台积极配合有助于提升平台的版权保护治理能力和质效。在此基础上，双方愿意协同开展版权保护治理合作。
Xiaohongshu recognizes that NBA, as an internationally renowned sports organization, owns IP assets of significant market value and has a legitimate interest in the continuous enhancement of copyright governance capabilities and effectiveness by online platforms. NBA and Xiaohongshu share the view that active cooperation between right holders and platforms can enhance the effectiveness of copyright protection and governance on online platforms. On this basis, both parties are willing to work together on copyright protection and governance.
NBA发挥权利人信息优势，积极提供有效版权治理所需的权利信息和治理建议；小红书发挥互联网平台技术优势，积极提供有效版权治理所需的技术保障和治理方案；小红书愿意持续加强技术和人力投入，NBA愿意持续配合，实现平台内版权保护治理的良好效果。
NBA will leverage its access to relevant rights information as a right holder by actively providing rights information and governance recommendations necessary for effective copyright governance. Xiaohongshu will leverage its technological capabilities as an online platform by actively providing the technical support and governance solutions necessary for effective copyright governance. Xiaohongshu is willing to continue to invest in technology and human resources, while NBA will continue to cooperate in these efforts, with a view to ensuring effective copyright protection and governance on the platform.
双方就版权保护治理合作定期交换信息和建议，持续提升版权保护治理质效，携手助力优质内容生态。
The parties will regularly exchange information and recommendations regarding their cooperation on copyright protection and governance, continuously enhance the quality and effectiveness of copyright protection and governance, and work together to contribute to a high-quality content ecosystem.
双方均对本案调解结果表示满意。NBA中国法务部高级总监专程到访WIPO仲调上海中心表示感谢。
Both parties expressed satisfaction with the outcome of the mediation. Senior Legal Counsel at NBA China subsequently visited the WIPO Arbitration and Mediation Shanghai Service to express appreciation.

About the WIPO Arbitration and Mediation Shanghai Service
WIPO仲裁与调解上海中心于2019年10月在中国（上海）自由贸易试验区注册登记，是中国司法部批准的首家在中国境内开展涉外知识产权争议案件仲裁与调解业务的国际仲裁机构。自2020年以来，WIPO仲裁与调解上海中心已处理了280余件涉外知识产权仲裁和调解案件，为中外当事人知识产权的保护和争议解决提供了新的路径。
The WIPO Arbitration and Mediation Shanghai Service was registered in October 2019 in the China (Shanghai) Pilot Free Trade Zone and is the first international arbitral institution approved by China’s Ministry of Justice to conduct arbitration and mediation of foreign-related IP disputes within China. Since 2020, the WIPO Arbitration and Mediation Shanghai Service has administered more than 280 foreign-related IP arbitration and mediation cases, providing Chinese and international parties with a new avenue for protecting their IP rights and resolving IP disputes.
